I. Introductory provisions

  1. This document describes the privacy policy contained on the website at www.cleanparts.pl and has been prepared based on the legal provisions in force in the territory of the Republic of Poland (hereinafter referred to as the ” Policy “).
  2. The purpose of the Policy is to define the principles, method of processing and use of data and information from website users, and also contains information on the rights of natural persons in relation to the personal data they provide.
  3. Please read this Policy carefully. By accessing or using this website and submitting any personal data to us, you accept the terms of this Policy.
  4. Please note that by leaving this website (e.g., by following a link to a website on a different domain), you are entering an area where this Policy does not apply.   5. The website and all its components are protected by law, in particular the Act of 4 February 1994 on Copyright and Related Rights (Journal of Laws of 2021, item 1062, as amended) and the Act of 16 April 1993 on Combating Unfair Competition (Journal of Laws of 2022, item 1233, as amended).
  6. Users are authorized to use all content published on the website, provided that copyright is not infringed. No part of the website may be used for commercial purposes without the prior consent of the website owner.
  7. The owner of the website and its authors are not liable for any moral or financial losses incurred as a result of using the content on the websites.

II. Personal data protection

  1. The Controller of Personal Data is AGAPIT Spółka z ograniczoną odpowiedzialnością spółka jawna with its registered office in Olsztyn (10-302), ul. M. Zientary Malewska 26, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court in Olsztyn, 8th Commercial Division of the National Court Register, under the KRS number: 0000880889, NIP: 7391016226, REGON: 510304047.   2. Personal data are processed by the Controller in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data
    and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as: ” GDPR “), as well as on the basis of other provisions regulating the protection of personal data of natural persons.
  3. AGAPIT Limited Liability Company, a general partnership based in Olsztyn, is the controller of personal data provided by users on the website. The Controller exercises due diligence to ensure that all personal data is processed in accordance with the purpose for which it was collected and used in accordance with the scope of granted permissions (consents) and the areas of processing permitted by law.
  4. Each person providing the Administrator with personal data via the forms available on the website is informed about the specific purpose for which the data is processed and the legal basis for processing. 
  5. The Administrator uses personal data only for the indicated purposes, in particular: (i) in the case of consent to contact via the contact form for the purpose of contact and providing information, (ii) in the case of placing an order via the website for selected products – in order to properly execute the contract for the provision of services.
  6. Personal data processed on the basis of consent will be processed until it is withdrawn or the purpose for which the data was collected ceases to exist. Consent may be withdrawn at any time without affecting the lawfulness of processing based on consent before its withdrawal.
  7. Data processed in connection with the conclusion and performance of the contract will be processed in accordance with applicable regulations, but no longer than until the expiry of the period in which the Controller may pursue claims related to the concluded contract.
  8. Personal data collected through all forms posted on the Administrator’s websites, including information such as name, phone number, email address, website address, and company name, is used solely to identify the Client, establish business contact with them, provide the Client with free materials prepared by the Administrator, provide a quote for services provided by the Administrator, conduct business negotiations with the Client, and, if applicable, sign and execute a contract. If the Client consents, the personal data provided will be used by the Administrator for marketing its own products and services or the marketing of third-party products and services, and for monitoring traffic on the Administrator’s website (profiling).
  9. Personal data collected through all types of forms posted on websites will be processed by the Controller for the time necessary to provide Customers with free materials or to quote the Controller’s services, for the duration of commercial negotiations aimed at signing the contract (but no longer than one year from the date of receipt of the commercial offer by the Customer), and then for the duration of the contract or service provision, as well as for the period during which the Controller is obliged to store sales documents.
  10. Personal data collected through all types of forms posted on the Controller’s websites are processed on the basis of the data subject’s consent (Article 6 paragraph 1 letter a) of the GDPR), as well as on the basis of Article 6 paragraph 1 letter b) of the GDPR, i.e. their processing is necessary for the performance of a contract to which the data subject is a party, or to take steps at the request of the data subject before concluding a contract.
  11. The Administrator’s Clients may withdraw their consent to the processing of personal data at any time. Withdrawal of consent to data processing does not affect the lawfulness of data processing carried out by the Administrator based on consent prior to its withdrawal.

III. Rights of website users

1. Data subject:

  a) processing purposes,

  • the categories of personal data concerned;
  • information on recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;
  • where possible, the planned period for which the personal data will be stored or, if this is not possible, the criteria for determining that period;
  • information on the right to request the controller to rectify, delete or limit the processing of personal data relating to the data subject and to object to such processing;
  • information on the right to lodge a complaint with the supervisory authority;
  • if the personal data were not collected from the data subject – all available information about their source;

b) has the right to demand from the Administrator the immediate correction of his/her personal data that is incorrect,

c) has the right to demand that the Administrator immediately delete his/her personal data in specified circumstances,

d) has the right to request the Administrator to limit data processing,

e) has the right to receive personal data concerning him/her provided by the Controller in a structured, commonly used and machine-readable format,

f) has the right, in the above-mentioned cases, to send these personal data to another controller without any hindrance from the controller to whom these data were provided,

g) has the right to object to the processing of his or her personal data,

h) has the right not to be subject to a decision based solely on automated processing of his or her personal data, including profiling.

2. The personal data controller shall provide the data subject with the above-mentioned rights under the terms and conditions set out in the provisions of the EU Regulation on the protection of personal data.

IV. Data Acquisition

1. The website www.cleanparts.pl uses so-called “cookies.” These are small text files sent by the web server and stored by the browser’s computer software. When the browser reconnects to the website, the website recognizes the type of device the user is connecting from. These parameters allow only the server that created them to read the information contained therein. Cookies therefore facilitate the use of previously visited websites.
2. The information collected includes the IP address, browser type, language, operating system type, internet service provider, time and date information, location, and information sent to the website via the contact form.
3. The Store uses information stored in internal and external cookies for the following purposes:
a) enabling the operation of basic website functions, including remembering the shopping cart and maintaining the user’s session;

c) creating viewing statistics for individual website subpages;

  1. The commercial offer presented via the website www.cleanparts.pl does not constitute an offer within the meaning of Article 66 § 1 of the Civil Code and other applicable legal provisions. Each page is for informational purposes only.
  2. Any matters not regulated in this Policy shall be governed by applicable law.
